The following Terms of Use (“TOU”) govern all use of the http://nestcargo.com website (“Website”) and also http://app.nestcargo.com application (“Webapp”) and all content and services available by Nestcargo (“Nestcargo”, “we”, “us”, “our”) at or through the Website and the App (collectively “Services”). The Website, Webapp and Services are owned and operated by Truckbird P.C., a company incorporated in Greece, with headquarters at 19 Akropoleos Street, Dafni, Greece 17234 (“Truckbird”).
You must be over 18 years old in order to use our Services. Our Services are offered subject to your acceptance without modification of all of the TOU contained herein and all other operating rules, policies and procedures that may be published from time to time on this Website by Nestcargo.
Please read the TOU carefully before accessing our Services. By subscribing to our newsletter or by registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Website and/or by clicking to accept or agree to the TOU when this option is made available to you, you accept and agree to be bound and abide by the TOU, our Pricing Policy, found here, our Privacy Policy, incorporated herein by reference and all other operating rules, policies and procedures that we may publish from time to time on the Website. We encourage you to review the Website and these TOU periodically for any updates or changes. If you do not want to agree to these TOU or the Privacy Policy, you must not access or use the Website.
Protecting your privacy and your information is a top priority for Nestcargo. The purpose of this Privacy Policy to explain how your business data and other information that you provide to us (“Business Information”) is protected, what information is collected and how it is used by Nestcargo. Those Privacy Policy provisions are part of our Terms of Use.
By visiting our Website and Webapp (collectively “Website”), you consent to our collection and use of your Business Information in accordance with this Privacy Policy and you are accepting the practices described herein. We do not transfer, sell or rent your business information to third parties in any way other than what it is stated in this Privacy Policy.
Please note that your access to our Services may be subject to certain third party terms and conditions and privacy policies, including but not limited to third party online storage services and payment providers. You agree that Nestcargo is not responsible for any such third party terms and conditions and their use of your Business Information. Unless stated otherwise, this Privacy Policy only deals with the use and communication of information collected by Nestcargo.
Registration is required for the use of our Services. Only registered Carriers have access to the Shipments uploaded by Shippers on our Platform and submit an Offer. You can register through our Website by filling in a registration form. During the registration process, you have to provide us with the following information:
Once we receive your registration application, we will call you to obtain your Company’s VAT number. Then, we will create an account (“Account”) for you at the Website and we will e-mail you a link to activate your Account. Once you access the link, you will be asked to enter a password and accept these TOU. Once you complete activation, and you will be able to create your profile (“Profile”).

The purpose of the additional information is to tailor our newsletters and e-mails to your business activities and preferences and to allow Shippers to evaluate your reliability.
You have the obligation to state truthfully, accurately and fully your up-to-date Business Information in the registration process and update your Account whenever it is needed. If your Business Information is not in compliance with these provisions or if Nestcargo has reasonable suspicions that your Business Information is not in accordance with these provisions, Nestcargo has the right to reject your application for registration or to suspend or terminate immediately your Account without prior notice. In this case, you have no right to any compensation for the rejection of your application, suspension or termination of your Account.
We automatically track and collect certain non-personal information such as Website navigation data and IP addresses. We use this information to do internal research on our users’ demographics, interest, and behaviour to better understand, protect and serve you and our community of Carriers.
We collect information about your activity and behaviour on the Website, such as your posts of any kind and/or the Offers you submit. We also collect Shippers’ reviews about you.
If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on our Website, we may store such information in our servers.
To protect you against fraud, unauthorized transactions (such as money laundering), claims and other liabilities, we do not collect credit card information.
We allow our third party payment vendor to collect information for the purpose of collecting fees from Carriers on the Website. We do not have access to the payment information that you provide to our third party payment vendor and this information is subject to the privacy policy of the third party payment vendor. You consent to our access to and collection of such information described as above under clause 2.
We treat all Business Information according to Greek and EU law.

In order to protect our Carriers' privacy, when a Carrier makes an Offer on a Shipment on our Platform, his identity, Business Information and any reviews concerning the Carrier, are not revealed to other Carriers or Shippers, except to the Shipper that owns the Shipment.
You understand and agree that your Business Information can be accessed by the Shippers who have accepted your Quotes in the past. You further agree that Nestcargo and its associated companies may use that Business Information for marketing purposes which may be directed to potential Shippers. Although Nestcargo makes reasonable efforts to restrict access to the above mentioned information only to the Shippers with whom you have contracted in the past, Nestcargo can not guarantee that other third parties will not, without Nestcargo’s consent, gain access to it.
You may ask Nestcargo to terminate your Account and thus disable access to your Business Information by Shippers at any time. However, you acknowledge that the Shippers and other parties who have previously gained access to your Business Information may have retained a copy. Nestcargo is not responsible for the retention, use or violation of privacy of that information in those instances, or for the use or privacy of that information by any of such parties while it is available on our Website.
Shippers may not publish or post Carriers’ private and confidential information. Any exchange of personal information required for the fulfillment of an Offer must be provided conducted privately between the Carrier and the Shipper.
All our employees, independent contractors and agents have executed non-disclosure agreements, which provide explicit confidentiality protections. Any employee, independent contractor or agent who violates such privacy and/or security policies is subject to possible termination and civil and/or criminal prosecution.
We do not make any of your Business Information available to third parties for their marketing purposes. Nestcargo’s software runs on individual servers and no data given or collected is shared with other social media platforms.
If however, we share your Business Information with third parties, we will notify you. Please note that no transmission over the internet can guarantee confidentiality and non-disclosure, and as such, you transmit at your own risk.
Nestcargo uses robust security measures to protect data from unauthorized access, maintain data accuracy, and help ensure the appropriate use of data. When the Services are accessed using the internet, Secure Socket Layer (SSL) technology protects your Business Information, using both server authentication and data encryption. These technologies help ensure that your Business Information is safe, secure, and only available to you and to whom you have granted access. Nestcargo also implements other advanced technology measures to prevent interference or access from outside intruders.
We do not tolerate Spam. To report Nestcargo-related spam please contact us at info@nestcargo.com. You may not use our communication tools to send spam or otherwise send content that would violate our TOU. We may check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content of the Website, but we will not permanently store messages sent through these tools.
Nestcargo does its utmost to secure communications and data storage in order to protect confidentiality of your Business Information against loss and interception by third parties. However, it is important to know that there is no zero-risk against loss or interception by others of your Business Information. You are responsible for maintaining the security and confidentiality of your Account’s username and password.
We save your Business Information in our database in order to improve our Website’s and user experience and in accordance with our TOU. If you wish that your Business Information be permanently deleted from our database when you stop using our Services, please notify us at info@nestcargo.com.
Nestcargo is using cookies to improve your experience of our Website. When you visit our Website, Nestcargo servers send a cookie to your computer in order to determine your location and use the appropriate language for our Services. You can delete these cookies at any time. Standing alone, cookies do not personally identify an individual. Cookies merely recognize the web browser. Unless an individual chooses to identify himself/herself to Nestcargo, such as through opening an Account or entering login information, individuals remain anonymous to Nestcargo.
We cooperate with law enforcement authorities, as well as with other third parties, to enforce laws, intellectual property rights and to prevent fraud. In response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can, and you authorize us to, disclose your name, e-mail address and Website use history, with or without a subpoena.
